TERMS OF SERVICE AND DIGITAL PRODUCT LICENSE

Last updated: October 16, 2026

These Terms govern your use of GIBBSVILLE.com and digital products sold by GIBBSVILLE & CO dba GIBBSVILLE (“GIBBSVILLE,” “we,” “us,” or “our”). By placing an order or using a purchased digital product, you agree to these Terms.

1. Seller information

Aggie@gibbsville.com

2. Orders and payment

You agree that the information supplied during checkout is accurate and that you are authorized to use the selected payment method. Prices, applicable taxes, and the total charge are displayed during checkout.

We may cancel and refund an order affected by suspected fraud, a pricing or technical error, or a legal restriction.

3. Digital products and delivery

The Heirloom Jewelry Keeper is delivered as a digital download containing PDF files, which may be packaged in a ZIP file. No physical item will be shipped unless a product listing specifically says otherwise.

After payment is confirmed, download instructions are sent to the email address entered during checkout. Customers should download and save a backup copy because a download link might not remain available indefinitely.

Fillable PDFs work best when downloaded and opened in Adobe Acrobat Reader. A browser or phone preview might display the file without supporting all fillable features. See our Shipping and Digital Delivery Policy for more information.

4. Personal-use license

After full payment, the purchaser receives a non-exclusive, non-transferable license to download, save, complete, and print the purchased files for personal, noncommercial use and for maintaining the jewelry records of the purchaser’s household.

You may make reasonable backup copies and share completed records with family members or professionals assisting with your jewelry, appraisal, insurance, estate, tax, or legal matters. This does not allow distribution of the blank templates or original digital files.

5. Uses that are not permitted

Unless we give prior written permission, you may not:

  • sell, sublicense, rent, give away, or commercially distribute the files;
  • upload or post the files online or place them in a shared digital library;
  • share or transfer blank templates or original files to other people;
  • use the files as templates for customers, clients, or another business;
  • remove ownership notices or claim the design or content as your own; or
  • create or sell a substantially similar product copied from the files.

Nothing in this section restricts any use permitted by applicable law.

6. Intellectual property

The product design, text, layout, graphics, and blank templates are owned by or licensed to GIBBSVILLE and are protected by intellectual-property laws. Your purchase grants a license to use the files as described above; it does not transfer ownership of the product or its intellectual property. Information and photographs entered into your own records remain yours.

7. Recordkeeping tool

The Heirloom Jewelry Keeper is an organizational and recordkeeping tool. It is not an appraisal, authentication, insurance policy, proof of ownership, or substitute for legal, tax, estate, insurance, or professional jewelry advice. Sample information is illustrative. You are responsible for checking the accuracy of information entered into your records and obtaining professional advice when needed.

8. Refunds and technical problems

Because digital files cannot be physically returned, purchases are generally final after delivery or access. We will assist with missing, incorrect, damaged, or inaccessible files and consider refunds in the circumstances described in our Digital Product Refund Policy.

Nothing in these Terms limits any refund, warranty, or other right that cannot lawfully be limited.

9. Privacy

Our collection and use of personal information are described in our Privacy Policy. Payment information is handled by Shopify and the payment providers available during checkout under their applicable terms and privacy practices.

10. Product availability and warranties

We make reasonable efforts to describe and deliver our digital products accurately. To the fullest extent permitted by law, the website and digital products are provided “as is” and “as available.” We do not promise uninterrupted website access, compatibility with every device or software application, or that the product will meet every individual purpose.

This does not limit any express promise in the product description or any warranty or consumer right that cannot lawfully be excluded.

11. Limitation of liability

To the fullest extent permitted by law, GIBBSVILLE will not be responsible for indirect, incidental, special, or consequential losses resulting from use of, or inability to use, the website or digital product. We do not exclude or limit liability where doing so would be unlawful.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania. This does not deprive a consumer of mandatory protections provided by applicable law.

13. Changes to these Terms

We may update these Terms for future website use and purchases by posting a revised version with a new “Last updated” date. A later revision will not retroactively reduce the rights attached to a completed purchase unless required by law or beneficial to the customer.
