Digital Product Terms of Use

These terms apply to The Heirloom Jewelry Keeper and other digital products sold by GIBBSVILLE & CO, doing business as GIBBSVILLE (“GIBBSVILLE,” “we,” or “us”). By purchasing, downloading, or using a digital product, you agree to these terms.

Personal-use license

A valid purchase gives you a limited, non-exclusive, non-transferable license to use the files for your personal jewelry and family-history records. You may:

  • download the files and save reasonable backup copies;
  • type information into the fillable files;
  • print copies or individual record pages for your own collection;
  • reuse the record pages as your personal collection grows; and
  • share your completed personal records with family members, heirs, an insurer, an appraiser, or a professional adviser.

Uses not permitted

Except as otherwise permitted by law, you may not resell, sublicense, redistribute, publicly post, upload to a file-sharing service, or give the blank files or templates to another person. You may not remove ownership notices, claim the materials as your own, use them for paid client work, or adapt them into a competing product for sale.

If a full refund is issued for a reason other than a duplicate charge, your license ends and you must delete unused blank copies of the files.

Ownership

Your purchase provides a license to use the files; it does not transfer ownership of the design, text, artwork, branding, or other intellectual property. The materials are owned by or licensed to GIBBSVILLE & CO. All rights not expressly granted are reserved.

Purpose of the product

The product is a personal recordkeeping aid. It is not an appraisal, authentication, proof of ownership, provenance determination, insurance valuation, title determination, or substitute for legal, tax, financial, insurance, estate-planning, or professional jewelry advice.

You are responsible for the accuracy of the information you enter, verifying important information with an appropriate professional, protecting sensitive personal information, and maintaining backup copies. Using the product does not guarantee insurance coverage, recovery of lost property, or acceptance of a claim.

Technology and file compatibility

We make reasonable efforts to provide working files as described and to assist with reported problems. We do not guarantee compatibility with every device, browser, operating system, printer, or third-party application. Browser previews may not support fillable fields, and a compatible PDF reader may be required.

Orders, pricing, and availability

The listed price for The Heirloom Jewelry Keeper is currently $17 USD. The price and applicable taxes shown at checkout control the purchase.

We may reject or cancel an order and issue a refund when reasonably necessary because of suspected fraud, payment failure, a pricing or listing error, or a legal restriction. Purchases are currently intended for customers in the United States.

Disclaimers and limitation of liability

GIBBSVILLE & CO does not promise that use of the product will prevent loss, establish ownership, determine value, satisfy an insurer, or produce any particular result.

To the fullest extent permitted by law, GIBBSVILLE & CO will not be liable for indirect, incidental, special, or consequential loss arising from use of the product. Any direct liability relating to a purchase will not exceed the amount paid for that product.

These limitations do not apply to fraud, willful misconduct, gross negligence, personal injury where liability cannot legally be limited, or any other matter that applicable law does not permit us to exclude or limit.

Consumer rights

Nothing in these terms excludes or limits any warranty, remedy, payment-dispute right, or consumer protection that cannot legally be excluded or limited.

Governing law and updates

These terms are governed by the laws of the Commonwealth of Pennsylvania and applicable United States law. This choice of law does not deprive a customer of any protection that cannot be waived under the law applicable where the customer resides.

If one provision is found unenforceable, the remaining provisions continue in effect.

We may update these terms for future purchases. The version displayed at the time of purchase governs that purchase unless applicable law requires otherwise.
